Was truly sad and disturbed to read of yet another death in police custody and I pen down my thoughts in this opinion piece. I shared/sent this to a couple of online media outlets yesterday (the ones I usually send my letters and opinion to) but unfortunately none have published it. In fact, there have been very little press coverage on the recent death in police custody of A. Ganapathy. In my opinion piece, I urge the formation of the IPCMC, to uphold accountability. The IPCMC should have been set up years ago! How many more will have to suffer the same fate as the late A.Ganapathy, Kugan Ananthan, Balamurugan & many more before we establish the IPCMC?

In a recent Federal Court decision which caught my attention, the Court emphasized the importance of the discoverability principle in determining the limitation period for filing negligence claims. Justice Dato’ Mary Lim highlighted that the clock starts ticking from when the damage resulting from negligence is discovered or should have been discovered with reasonable diligence. This ensures fairness and balance in civil litigation, aligning with the policy and intent of the legal framework. The ruling clarifies that it would be unjust to require claimants to file before the contingent damage occurs. Consequently, the Court deemed the Appellants’ claim initiated in 2016 as not time-barred, overturning the Court of Appeal’s decision. As today is the 1st day of Syawal, I find myself reflecting on the beauty of togetherness that my family shares. Although I’m not Muslim, Hari Raya Aidilfitri has a special place in my heart as growing up in a multiracial and multi-religious family, I’ve been fortunate to experience the richness of various cultures and religions firsthand. Hari Raya is a time for joy & togetherness. As we exchange warm greetings, share delicious meals, and embrace loved ones during this time, let’s also celebrate the values of compassion, understanding, and unity that this celebration entails. To all my Muslim friends & colleagues, I extend my heartfelt wishes for a joyous and meaningful Hari Raya. May this festive season bring you abundant blessings, happiness, and peace. Selamat Hari Raya! 🌙✨ #HariRaya #UnityInDiversity #EidMubarak
